My husband and I bought a house together. My name is not on the mortgage, just on the title to the house. I have had some unexpected past bills show up and we are afraid of a lien on the house so my husband and I would like to remove my name from the title.
It may be better for you to deal with the past bills head on and try and resolve them rather than transfer assets and avoid creditors. Because if the creditors realize that you have had assets and that you did transfer them to avoid an attachment or lien then they can try and set aside the transfer as fraudulent. In any event, you have to have a new deed drawn up transferring the title from you and your husband to him alone and have the deed filed in the county clerk's office in the county in which you live (some states call it the registrar of deeds).
