How do I convert Separate Maintenance papers to Final Divorce papers?
Question Details: For the first year of my divorce, my ex and I were on a separate maintenance plan which required me to keep him on my insurance. Now that year is over and I have been told that I have now file final divorce papers to actually finalize the divorce. How do I convert our Separate Maintenance agreement into Final Divorce papers? There is a clause which states that nothing can be modified. So do I just have to take out the paragraph about the separate maintenance and then re-file?

I assume that the case was initially filed as a separate maintenance action and you now want to convert the case to a divorce. This can be done by filing the appropriate pleadings in the pending case to have it converted to a divorce case.
You will probably need the help of an attorney to have the case converted from a separate maintenance case to a divorce case.
The existing clause that says nothing can be modified will have to be removed from the existing pleadings by omitting it in the amended pleadings you will need to file to have the case converted to a divorce.
