How can I remove myself from my parents will and give up my right to receive anything from the estate?
Question Details:
Your parents would have to draft an amendment to their Will called a "codicil" (or draft a new Will) removing you as a beneficiary; you cannot do this yourself. If for some reason, they choose not to do so, then upon their death you can elect to waive your rights to any inheritance. To bring this about, you would have to give the waiver in writing. This will assure the court that you were not being pressured by anyone to give up your inheritance. There may be a prescribed form of waiver in the probate court having jurisdiction over the estate so you need to check; if not you should have an attorney draft a waiver form for you to sign. Typically this form does not go to the court (unless there's some kind of dispute); rather it is kept by the executor of the estate (or an attorney if there is one).
Note: When someone makes an election to waive a gift, the gift falls back into the residue of the estate and will then be paid or given to someone else in according to the Will.
