How can I change the deed owned by two unmarried, but cohabitating people, from "Tenants In Common" to tenents in common with rights of survivorship?
Question Details: My partner and I own a home, with mortgage, as "Tenants in Commom, with Warranty Covenants". Commom is the word used on the deed! We are not married, yet, and would like to make certain that if one of us should fail, the other will inherit the house without going thru probate or fending off creditors of the deceased. Refinancing is not an option! Is there anyway we can make this happen?
You can convey the property to yourselves a joint tenants with rights of survivorship. You should have an attorney prepare a quit claim deed. The deed will not impact your mortgage as the property is already jointly owned. There will be no conveyance taxes but you will have to pay the recording fee.
