Hit in Ohio by an uninsured motorist in a rental car.

Question Details: I was hit by an uninsured driver who was driving a rental car. My insurance has paid off my truck as I have full coverage. Went to open bodily injury claim and my insurance told me that rental car company is going to handle my claim. Rental car company is offering about 1/2 what I believe the claim is worth. They offer just enough to cover wages and med bills with no pain and suffering. What is their limit of responsibility, should I get a lawyer and can I force my insurance to pay the claim?

I am a lawyer in CT and practice in this area of the law.  you need to hire a lawyer.  your insurance company wont pay unless there is insufficient coverage of the other policies.  you need to have a lawyer file suit and try to negotiate a settlement.  you also need to continue treating with a doctor as you may not be in the position to determine the amount you should demand.  hire a lawyer asap.
