Fired for false allegation and denied new employment because of it, what are my legal rights?

Question Details:

I worked for a sanitation consultant firm, that was under contract with a poultry plant. An employee of the poultry plant made a false allegation to the poultry plant that I was in the ladies room with another female employee. I was fired with no proof of this incident. The only thing I could really do was tell my employer I did not do this thing. Okay, new sanitation firm came into the poultry plant under contract and a job was offered to me. I went in one night and the next day, I was told that they could not hire me because the poultry plant made them aware of the allegation. Is this right? Is this defamation?

Employment and Labor Law Answers

You have a claim for defamation against the employee, who originally made the false statement to the poultry plant and also against the poultry plant for communicating the false statement to the sanitation firm.  The employee's statement made with knowledge of its falsity to a third party (the poultry plant) causing the loss of your job constitutes defamation.  In addition to the party who made the original false statement, anyone who diseminates the statement is also liable for defamation which occurred here with the poultry plant's communication to the sanitation firm.
