What to do when confidentiality/non-disclosure agreements are violated?

Question Details:

I hired a freelancer for a small part-time job. He violated agreements that I had him sign regarding confidentiality and non-disclosure.  He did this by contactingbya  clientand spreading gossip. How can I protect myself other than having these two agreements on file? I hope he doesn't start a small claims court case. He signed a confidentially/non-disclosure form, as well as a freelancer's agreement. It is a small business, an audio transcription service and I wish to make sure I am not harassed further.

I am a lawyer in CT and practice in this area of the law.  Confidentiality agreements and nondisclosure agreements are enforceable.  The question is whether the person violated these sections of the contract by soliciting your clients.  Does the contract have a noncompete/nonsolicitation clause in the agreement?  If so, you could file an injuction against the guy and seek damages for money that he made off your clients.  I suggest making an appointment with a lawyer to review the documents you have signed and determine whether to pursue legal action, which could be expensive.  Most lawyers will meet with you initially for free.
