How can I move out-of-state with my two children (one of them is his biological son), if my soon to be ex-husband does not want me to move?

You're going to have to get the court's permission for the out-of-state move, and that might not be possible (or wise) until the divorce is finished.

Many courts, today, are more likely to grant a request like yours than they would have been a few years ago.  The best way to persuade the court to do this is to have a specific destination, and information about how and where you would live and work, the schools and other resources for your children, and any friends or extended family you have there.  You can expect to be called on to share some of the extra transportation expenses that will be needed for your husband to get his time with his son;  rather than an impractical alternate-weekends schedule, he'll probably be given visitation for a few longer stretches, during the summer and school breaks.
