Can I pick up my daughter at school if I have a protective order against me?

Question Details:

I have a girlfriend who came home so drunk she assaulted me, then she tripped over the bed spread and cracked her head open. I got arrested. Since now there is an order of protection against me, can I legally go to my daughters school and pic her up if I want? My girlfriend and I have equal custody with no residence or domain set up.

It would depend on if the protective order also covered your daughter specifically or if it even addressed the issue of equal/joint custody of your child.  If you didn't bring it up to the court, you may need to because in case you decide to pick up your daughter and your girlfriend decides to show up, you could technically be in violation of such order.

Further, if you live together it could complicate matters.  If the two of you have reconciled, she would need to dismiss the order or explain it should be discharged due to reconciliation.
