How can I get my Chapter13 converted to a Chapter 7?

Question Details:

I filled Chapter 13 bankrupcty in 2008. I still owe about $30,000. I seem to make too much for Chapter 7. I make about $3,800 a month. I am paying $915 a month to the trustee right now. Another $1000 a month just in rent for this area. I am falling behind in my payments. What are my options here? I can't keep doing this. It's making me sick. I went in to try to lower my payments and they raised them because I was behind.

If your income and/or expenses have changed since you filed your Chapter 13 case, you need to file a Motion to Modify your Plan to lower your payments.   This is how you deal with it unless there are certain minimum payments you have to make (such as curing an arrearage on your home, or taxes).  You should discuss these options with your attorney.
