Have not been able to setup an appointment for almost a month with doctor due to migraines after initial visit? Am I allowed to sue for malpractice?
Question Details: I have had migraines for about a month now. I have only been able to see my neurologist 1 time (my initial appointment), and whenever I have called the office over the past 30 days to setup an appointment to see the doctor the staff nor doctor will allow me to. They completely ignore my request. The doctor prescribed me maxalt but I am limited to how much I am prescribed/month and go days in pain and haven't been able to advise him this. Since I've been out of work my employer wants me to be on short term disability but I can't tell the doctor this because I can't communicate with him.
This is not malpractice. If you unable to get an appointment, call another doctor.

Being able to get an appointment is hardly professional, but it doesn't rise to the level of malpractice. You also have a straightforward remedy for the situation, which you should pursue (since you need to take care of your health first and foremost): if this doctor and/or his office is not responsive, find a different doctor.
