DUI - previous offenses.
Question Details:
I have a 3 DUI's in different state 24 yrs ago; never went to court. Will this be a 1st conviction in Florida?
DUI's in othwer states will likely count towards determining the penalty. However, the 24 year period that you say was the last DUI will likely make this a 1st offense. However, I do not have your record. I suggest that you hire a lawyer as it is likely the the state will have your record from other states. You want to make sure you are not taken advantage of.
Florida is a state with a ten-year ‘washout period,’ also known as a 'look back period', this means that a prior conviction is not admissible after ten years. If it is ten years and one day since a driver was convicted of DUI, that driver will be considered a first-time offender. If a driver commits a DUI within ten years of the first DUI, they are considered guilty of a second offense and are subjected to harsher punishments.
