Subsequent DUI

Got my 3rd DUI; 2nd DUI was over 14 years ago. Received 2 -5 years in jail. Thought penalties were different if over 7 years ago.

While a DUI stays on your record forever, by virtue of something known as the "look back period", the court will only look back into your record a certain period of time for sentencing purposes.  In California this period is 10 years.  Since your previous conviction(s) was more than 10 years ago, then this will be considered to be your first offense.
