If I got a ticket for no car insurance and expired stickers but the car was later totaled, what do I do?
Question Details:
I got a ticket for no insurance, incomplete stop, and expired stickers. My husband got into a car crash a couple weeks after and the car was totaled. My court date is coming up and I don't know what to say or do. I want to know what the judge or lawyers will say to that because there is no reason to get car insurance or update stickers. Just the uncomplete stop.
Explain what happened to the Judge and that you were in the process, as you say, of rectifying the problem when the car was totalled. And now you are not going to be going through with obtaining the required insurance and stickers at this time. It may lead the Judge to feel sorry for you and reduce the tickets a bit but the fact remains that you were responsible for having them at the time the tickets were issued. And you will still have to pay.
good afternoon:
Because the car is totalled there would be no reason to update the stickers or the insurance. What you will want to do is bring proof that the car has been totalled to the hearing. You will speak to an attorney, show then the proof that the car was totalled. then simply explain the situation express that you know the incomplete stop would still be an issue and try to plead out.
Although i do not practice in KS the general assumption from my experience is that the court will understand and it shouldn't be an issue. Just be honest.
