Was granted PFA in one state and allowed to move to another but husband cancelled debit card; how do I return for hearing?
Question Details:
Was granted emergency PFA from husband in GA where we moved 6 months ago from DE. My 4 kids and I were permitted to return to my parents in DE until hearing date. Among other things, husband told not to touch assets. He cancelled my debit card and I have no money to get to hearing (700 miles away) or to hire lawyer. Mental and physical abuse to me. I intend to divorce him.
So your husband violated the order and is going to be held liable for that but it does you no good now while you are stranded 700 miles away. Could you borrow money in order to get to hire a lawyer and get to the hearing? Then the attorney can explain everything to the court and figure out some way to make sure that you have continued support pending the divorce. Otherwise you will be in trouble if you do not return for the hearing yourself. You may qualify for legal aid or legal services as well. Try giving them a call. Good luck.
Since money is an issue, in addition to legal aid, see if they can recommend someone to help you if they can't. Also, check if there is a law school nearby to where the hearing is being held; they typically run free/low cost clinics that handle these type cases. Additionally, you can contact the local Bar Association in county where all of this is occurring; they may have a list of attorneys who will take your case "pro bono" (for free) or at least for a reduced fee based on your income/circumstances. Finally, you can, google women's support group in the area; they may be able to point you in the direction of help.
