Question Details: Can I get my license back before having to go to court for my DUI? I have not been "convicted" yet.??

Typically, in most states, you cannot. If you are going to get it back it will be given to you after your court date. You should confirm this with a DUI attorney in your area. The fact is a DUI triggers both a civil and criminal case. A lawyer may be able to get the charge dismissed based on a technicality or at least reduced.
