Getting divorced in Virginia under grounds of desertion.
Question Details:
My husband filed for divorce under desertion. However, I left for my safety because of abuse from him. Also, for the first 4 months (5 total) of our separation we were working (meaning he was supposed to work on his anger, and I was trying to find myself again) towards staying married. I am really very confused about everything right now. Neither of us have money for lawyer, but his parents paid for one for him. Please, I need all the help I can get! I can't even find the law that tells me how to file my response to the petition and I only have 19 days left. Please help!
You will have to file an awnswer which explains why you left. Detail the abuse you suffred from him and that he forced you to get away for your safety. Even after filing the divorce, you will need a lawyer to help you with presenting your case that his abuse drove you away. Also you may need to seek support from him or anything else you want (property, money etc.).
I hope this helps. Please feel free to contact me if you have any further questions.
