Force vs vandalism

Question Details:

Every other Saturday night or so someone tries throwing a rock or piece of cement thru my second story window. If I hideout and catch him in the act, how much force can I use to detain him until the cops arrive? As long as I do not fire a weapon, can I use one to intimidate him without arrest to my own self?

Criminal Defense Law Answers

I am a lawyer in CT and I practice in this area of the law.  The law does not permit you to use deadly force to defend your property.  Likewise, the law would not permit you to use physical force to defend your property especially where your life is not in any danger.  I suggest that you have the police outside watching your house and ask them to patrol the house to try to catch this person as the law does not like people taking it into their hands.
