Question Details: For an employment background check for a teaching position in Arkansas (in 2009), will a DUI from New Jersey (in 1998) appear on the record? I would like to apply for a position this year, but would like to know if the DUI will show up in the criminal background check performed in Arkansas. If it will appear in a reort this year (11 years ater), I could wait to apply until next year (2010), if it will NOT appear after the 12 year point. Thank you.

My research suggests that a DWI in New Jersey is not a "crime";  it is a traffic violation.  Therefore, the DWI should not show up on a "criminal background check."  The DWI will however, show up on your motor vehicle history (although after 10 years it will not be a factor in sentencing on a subsequent offense).

Since I am not licensed to pratice in New Jersey, you should confirm this with an attorney who is.
