Insurance has nothing to do with fault.

If the at fault party has insurance the result will not really differ depending on the status of the party who was not at fault. In general it will be handled in the same manner. If there is an issue beyond a normal accident and there are possible implications towards a lawsuit it would be best to consult with a local attorney to prepare in case there is a problem. However if it seems black and white your best solution would be to speak with your insurance company they would deal with this all the time and can walk you through the process.
