Question Details: I noticed that in Maine if you are over .15 BAC there is a 48 hour jail sentence that can be enforced. Is this a mandatory charge they hand out or is it possible to avoid that. And if so how would I go about getting it reduced?
I'm not a Maine lawyer, but my research suggests that the 48 hour jail sentence is mandatory. If you are convicted of DUI with .15 or higher, you are going to jail, and I'd be very surprised if there's any way out of it.
At .16, you were at twice the legal limit. Drunk driving is dangerous, and you should not expect to get much sympathy from the court, for whatever hardship the jail sentence might cause you.
