I am a lawyer in CT and practice in this area of the law. Usually, all states have a first offended program that will allow you to get into a program that will result in a dismissal of the charge. The court does not based granting the program on the BAC level. If you hire a lawyer you will be in the best position to know what programs are offered and will hve someone fighting to get you in notwithstanding the high BAC level.

Although I do not practice law in the State law in the State of California, here are my initial impressions. I generally agree with my colleague's comments; however, I would like to add an additional perspective. It sounds like you were held in the police station prior to posting bond. While you may later get credit for this jail time (if bond was set while you were being held) it is separate from any resolution of your case. I agree with my colleague that you should hire an attorney in the interest of obtaining a favorable resolution of this matter. Good luck.
