Question: Auto Accidents - California

Firefighter involved in an accident in personal car while on duty driving between stations.

What is the legal responsibility of an agency when an on-duty firefighter, using his own vehicle to transport himself and his personal protective equipment from one fire station to another, gets involved in an accident along the way? Is there any case law on this subject?

I am a CA lawyer.  Since the firefighter is on duty, the employer is reponsible.  There is a lot of case law in this area.  Search for cases discussing course and scope or respondeat superior.  Make sure that you comply with the CA Tort Claim statutes as well (the time to file a claim is 6 months).
