Question Details: The case in question was refrenced to on a court docket from a car accident I was in when I was 17. The original charge was reckless homicide but after going to court it was dropped to reckless driving. My company asked to see the papers and I showed them and all was well. Then 2 years later we are bought out and this company runs the background check and see the same thing. I send them the same paper work but they see reference to another case at the bottom of the dockett. Turns out this is a misdemeanor theft under $300 for a check someone wrote me, but isnt SEC compliant. Can I do anythig
I'm afraid that there is not much that you can do here. Most employment relationships are what is known as "at will". This means that you can work for an employer, or not, your choice. In turn, the employer can hire or fire someone for any reason or no reason whatsoever.
The only exceptions to this are: 1) If there is an employment agreement or contract (which governs termination); 2) If there is a union or collective bargaining agreement (which governs termination); 3) If there is an employee handbook or other official policy statement (which governs termination); 4) If discrimination is a factor (there can be no termination for reasons of race, religion, age, disability, sex, national origin).
