What are my financial rights/responsibilities in a divorce?
Question Details:
I have been married for 5 years. My husband and I brought a house in the marriage and 1 car. The car was brought for me. My used car got the new car with trade in. He has his own car. Now he wants to keep the new car and the old car. Also he wants the house. Can he keep the car if he was paying the note on the car? The house is in foreclosure. He wants to say that it is going back to the bank because I left and he doesn't have money to pay all the mortgage on the house. Will I be made to pay for the house too.
Good evening:
Sorry to hear about your situation. unfortunately it is very difficult to give an answer to a question like your without speaking and knowing more specifics regarding your situation. One answer i want to offer is that if the note is in both your names on anything that is unpaid you both can be held liable for any resulting debts.
As far as who will get what that will be something decided among all parties through discovery and a potential hearing. What you should do is consult a local attorney who specializes in this area of law and speak with them. they can help you get a better idea of the possible outcomes and assist in getting the best result for you.
Good luck and thank you for coming to our site. please let us know if we can be of further assistance.
I am very sorry to hear about your situation. I am a divorce attorney located in the Milwaukee area. I often hear these kind of bullying situations. You have what the WI courts consider a short term marriage. The courts basically will look at the value of all the debts and the assets and try to balance them. So it does not matter who paid for what in the past, what matters is the values and who will make payments in the future. If the house is in foreclosure it will likely be that neither of you owe any money once the bank takes it back. I can help you. Contact me at 414-352-4600. Cheryl P. Baraty, Baraty & Polansky, LLP
