Family member being held on charges and keeps getting a court date for some kind of announcement but with no resolve.

Question Details: A family member has been charged with: Engage In Organized Criminal Activity a 1st degree felony. He was picked up on 12/15/08 and has gone to court several times without any resolve. There is constantly an accuse that the prosecuter is busy. How long can they keep doing this?? I am having some doubts on our lawyer as well, what should i tell the lawyer as well?? The general rule is that the criminal justice takes some time, and it is not unusual for there to be some delay in obtaining a resolution.  That being said, a defendant has a constitutional right to a speedy trial, and in rare circumstances unnecessary delay on behalf of the prosecution can result in the granting of a speedy trial motion and therefore the dismissal of the charges.  In any event, you need to discuss this matter with the attorney who has been retained to represent your family member.  If you are unsatisfied with his advice, you should consult with a different local attorney to discuss these matters in greater detail in the interest of obtaining a second opinion.
