Ex-wife conceived with another man during our marriage but gave birth after divorce was final, what are my legal responsibilities?
Question Details:
My ex-wife and I got married in CA. She left me for another man while I was in Iraq. She got pregnant from this man in AZ. They broke up and now she's with another man in ID. She gave birth two weeks after our divorce was final. She waived all rights in the judgment and as I'm not the biological father; child support was also waived. She recently wrote, saying the state of ID requires a paternity test from me. Until then I'm considered to be the legal father since she conceived while we were married, and that I may have to pay child support. Does this negate the divorce judgment? Do I have to do anything?
You should contact an attorney in Idaho and provide the attorney with a certified copy of the divorce judgmetn stating you are not the father. You can attempt to do this on your own without an attorney by sending correspondence to the state of Idaho, but because of the number of states involved and complex legal issues, it would be preferable to consult with an Idaho atttorney.
