Question Details: My mother recently passed away, and it turned out that she had forgotten to change the beneficiary on her life insurance policies from her ex-husband. They have been divorced 7 years, and those were the best of my moms life. My two sisters and I are wondering if there is any legal way to contest the policy in NC.
Typically, in most jurisdictions, in the case of a divorce where the ex-spouse is still listed on an insurance policy or annuity, etc, the contingent beneficiary listed is paid the proceeds. If no contingent beneficiary is designated then the proceeds are paid into the probate estate and distributed accordingly.
