Question Details: My husband found out a couple of months ago that his ex-girlfriend had filed for bankruptcy a couple of years ago. She included the mortgage where we live and they also put the bankruptcy on his credit. Is this legal? And also we were never told about this by the mortgage company or her. Does he have any rights? After he talked with the finance company they said she signed an agreement that he would not be one day late with the payments. Please someone help us.
If your husband was a co-signor on the mortgage, it will appear on his credit report when she filed the bankruptcy. If he was not on the mortgage it should not appear on his credit report. If the information is wrong, write the credit bureau as instructed on the credit report and the credit bureau is responsible for verifying the information.
In the event she somehow included him on the mortgage without his permission, you need to contact the mortgage company to review all signed documents.
