Employer taking insurance premiums from 2 years ago.

Question Details: My husbands employer pays most of his health insurance premiums, he has worked there numerous years, he quit and then went back as a 're-hire' over 2 years ago. The book keeper discovered and error today that she had made over 2 years ago, and is now trying to hold out $275.00 per check for back premiums. This amount out of his check will put us in a terrible financial crisis. We are not the only family that this has happened to in the company.

Employment and Labor Law Answers

Probably not.  I suggest you call the Montana Insurance Commissioner and ask if the employer can backcharge for premiums.  1-800-332-6148.  The wage and hour division at your local job service should be consulted about this deduction.  Finally, get signed up with the job service.  Montana's wrongful discharge law is not very helpful to most workers who get fired because the damages are limited.  Good luck.
