Employer is auditing dependants covered on medical insurance. can they drop spouse due to insufficient documentation?

Question Details: My employer, Continental Automotive is auditing dependents on med. insurance. My spouse is at risk of getting dropped because we filed separate head of household. I filed extension on taxes, have no doc. of filing status. I need to file appeal form as to why we filed as such. I have been employed with this co.for 17 yrs and always had coverage for spouse. They say there is no alternate form of documentation I can submit. Is it legal to drop coverage when there is no other doc. offered I can submit. I feel wronged. I will file the appeal form, just wondering what are my options?Tx.

The way you file taxes has NO bearing on marital status for purposes of health insurance--if you are married and your company health plan allows coverage of spouses, then it doesn't matter whether you file jointly, separately, etc. Presumably, you have other evidence of marriage, including your marriage license.

Try calling the insurer directly to see what documentation they accept. If they accept other forms or proof, then take that answer to your employer; also, try calling your state dept. of insurance and asking them how to go about making sure your spouse is covered under your health plan.
