DUI / DWI Law Answers

There is no provision in Alabama that allows for the expungement (clearing) of criminal records.  If you are convicted of DUI in Alabama, it is basically on your record for the rest of your life.  The only exceptions are if the court grants you "Youthful Offender" status and or your case is heard in juvenile court.  In both of these cases your record is sealed and the conviction can not be later used for sentence enhancement.

As for your DMV record, a DUI remains permanently as well.  However, by virtue of something called the "look back period", the court will only look back 5 years into your record.  If you get a subsequent DUI and 5 years have elapsed since your first, the second offense will be treated as your first for sentencing purposes (with the exception of Youthful Offender status or juvenile court proceedings, as explained above).
