Question: Auto Accidents - New York

Asked on 9/16/2009
Door ding in parking lot, who's responsible?
At a football practice a lady parked next to me. I take several kids home from practice as they got in car they dinged her plastic strip on her door. They appologized & so did I. Now she wants a hundred dollors to take strip off & paint it? Do I have to pay it? She parked after me & no one next to her, not a lined parking area. Left typical small ding nothing large. Thank you

I am a lawyer in CT and practice in this area of the law.   A court is likely going to find that you had the responsibility top make sure the kids were being safe when getting out of the car when there are cars parked next to you.  I would explain the situation to the kid's parent who dinged the car and ask the parent to reimburse you for the money you pay to the lady's who car you dinged.  Or you can ignore this and let the lady try to come after you and force her to sue you.
