Does time in between DUI's matter in the State of Arizona?

Question Details: I was arrested for my 2nd DUI Friday evening. I blew right at .08. I was convicted of my first DUI in Aril of 2004 and was not extreme either. I have an arrignment on 9-18 where I will be meeting with my public defemder, I am just not sue what to expect. Will the 5 yeahrs in between convictions aloow me to get face the same penatlies as a first time defender, or it being my second DUI, regarless of time apart, will I face 2nd offenders penalties? thanks so much.

I'm not an Arizona lawyer, but my research suggests that you have managed to clear your state's 60-month (exactly 5 years) period to look back for prior DUI's.  So, you should be sentenced as a first offender.  This doesn't guarantee, though, that you'll still get the miminum first-offender sentence.

This is a very good thing.  A second-offense DUI carries a mandatory 90-day jail sentence, with at least 30 days to be served consecutively, a $500 fine and a one-year driver's license suspension.
