No.  If the statute of limitations is approaching and the case has not been settled with the insurance carrier, you will need to file the lawsuit prior to the expiration of the statute of limitations.  Failure to file the lawsuit prior to the expiration of the statute of limitations may result in your losing your rights forever in the matter.
