Does my husband have legal rights to the home if he is not listed on the mortgage?

in a divorce, all property is part of the "pot" that gets divided between the paerties.  so your real estate is potentially subject to a claim from him.  if it was yours coming into the marriage and you are likley to continue to live in it then you have a good chance to keep it.  many factors come into play.
