Question Details: Trying to get my ex off the title, we are not legally married. I only put her on the title to keep her from being on the streets if something happened to me. Does she have legal rights to the property? She cant verify she has ever paid on the mortgage. How can I get her off of the title?
Yesm, your ex does still have an ownership interest in the property. The only way to get her off the title if she does not willingly agree to give up ownership would be to file a partition lawsuit against her.
One way to attempt to convince her to willingly give up her interest would be to offer to buy her out. If you and she can agree on a price, she would sign a deed giving you her interest and you would pay her the agreed upon amount.
Her lack of payment on the mortage only goes to show how much interest she might have.
