Does my 17 year old son have the right to a court appointed attorney in a misdemeanor case if the states attorney is not seeking jail time?
Question Details:
I am disabled and cannot afford a lawyer for my son. When he requested one in a misdemeanor case (he is charged with driving without a valid license) he was told by states attorney he could not have one because they were not seeking jail time? Shouldn't he be entitled to a lawyer?

The DA is right. If there is no jail time, then he is not entitled to an appointed attorney.
