Does a bank have to accept a divorce settlement that moves community property home in CA to one party, if wants to keep it?

Question Details:

Planning to have a peaceful divorce. We have agreed that she will keep her assets and the house that is underwater while I keep my debt. Will the bank for this community property house we own in CA have to accept this settlement? If we already agee on everything, but the worry is the community property house. Do we need an attorney to do this divorce or filling divorce papers ourselves will do it? House underwater is the sticking point of concern.

You need to consult with an attorney. The bank is not bound by any agreements you make. Your settlement needs to be structured in such a way that you each can indemnify and hold the other harmless on debts you assume
