Does a county jail have to return an inmate's medication after the inmate is discharged?

Question Details:

Inmates at our jail are seen by a physician and medications furnished by our own mail-order pharmacy. However, they often have medication on them when arrested. We hold this medication until they are discharged. Do we have to return the meds to them after discharge or can we destroy them? What if the meds are controlled substances? How long would we have to wait until we destroy the meds?

This is a question that must be answered by your County Counsel.  It should not be answered by a private attorney unless retained by your County Counsel for that purpose.
