Question Details: Does a company have the right to GPS track sales people in their personal vehicles? Location is Knoxville, TN. The device also allows for clocking in/out, but does GPS track the vehicle. Multiple employees, including non-management have real-time access to the data. Many Thanks

I am a lawyer in CT and practice in this area of the law.  While you are on the clock the company may track your whereabouts.  Employees at will like yourself may be hired or fired for good bad or no reason at all.  also, the employer may control your work envinronment while you are employed and on the clock - i.e. know where you are at all times.  If the gps is tracking you while off duty, then you should speak up and ask that the device be removed during nonwork time hours.  however, you may quit the job if you want altogether.  the choice is really yours as there is no state action that is violating your right to privacy.  if you do not like this then ask your boss to remove the device while you are off the clock.  maybe you can reach a compromise.
