Do we have any legal right to contest a Will for our part of an inheritance?
Question Details:
My sister and I were left out of my father's Will. He left everything to his wife; as far as I know we were never mentioned in the Will.
Generlly, children of a decedent have standing to contest a will. Most states have omitted heir statutes that govern this issue. If your father simply failed to name you without specific language disinheriting you, you probably have a good chance on a will contest. I would suggest that you speak to an estate planning/administration attorney as soon as possible.
