Do New York Maritial Separations Expire?

Question Details: My boyfriend has been legally separated for 4 years. I was just wondering if the Separation Agreement expire or become null and void if e doesn not proceed with a divorce in a certain amount of time. Thanks for your time.

There is no expiration date on a Separation Agreement, as long as it is in proper form and properly executed.  The only way the Agreement can become invalid is if the parties were to reconcile.

Either party can file for what is called a conversion divorce after living apart pursuant to a separation agreement for one year.  The filing party must be in substantial compliance with the agreement.  I am a New York matrimonial attorney.  Give me a call if you would like to discuss the matter.  It would be my pleasure to speak with you about the case.   www.NYAttorneyDivorce.com www.CriminalDefense1.com
