Do i need do pay for a car accident that happen in my drive way

Question Details: I was backing up of my driveway and i hit a car that was passing by. The car did not stop when I hit it and keep driving. So the whole side of the car was damage. The other driver is asking me for $1,000. I want to know if I need to pay. I do not think it was my fault

Generally, when you are backing up out of your driveway, you need to yeild and give the people on the road the right of way.  If you backed up while th ecar had the right of way, then most juries will find that you failed to cautiously back out of the driveway and are at fault for the accident becasue the other driver on the road was coming and you should have waiting for him to pass before getting out of your driveway.  I suggest however, that if there is no poice report, then you can make a claim to his insurance company that he was at fault and try to see if you can get his insurance to cover this claim.  If you do not have his insurance info, then sue him in small claims court and let  a judge decide who is at fault.
