Question: Divorce, Marriage, Alimony - Florida

Asked on 10/15/2009
Do I need an Attorney to file for a divorce, 30+ years, husband left 2yrs ago, no minor children, has a house.
Husband left home 2 years ago, not sure where is leaving. do know where he is working. I live in the house, but does not receive any financial support from him. I have had to use some of my retirement saving to live on last year after i lost my job. Now I only have a part-time job. can i file for abandonment and request spousal support and reimbursement to replace retirement saving and keep the house? can I get him to pay for the divorce?

AttorneyPages has verified that this person is an attorney.

With a 30+ year marriage, you have a presumed entitlement to spousal support by virtue of your long term marriage. However, there are several other factors that also need to be considered in order to determine how much, if any, and for how long spousal support might be paid. Additionally, other equitable distribution issues would need to be determined, including the equity in the house if there is any. I would strongly suggest that you speak with an attorney in order to fully determine your potential rights and options.
