Do I have to pay rent for the month of Nov?

Question Details:

My original lease ended on 10/01/09 and a new lease was never created. The rent for October was paid. The landlord now wants me to pay for the month of Nov stating that I didn't give a 30-day notice. There never was a new lease created, so how would a 30-day notice apply?

I am a lawyer in CT and practice in this area of the law.  Your obligations are govered under the lease.  If your lease requires that you provide notice to the landlord to avoid paying the rent in Nov., then you may be obligated to pay, especially if you are still residing at the property.  if your lease is silent on this, and you moved out in Oct., then you should not have to pay for any rent in Nov.  I suggest taking the lease to a lawyer to review it. most lawyers will meet with you for the first time for free and be able to give you some direction here.
