Do I have to pay preschool tuition if I took my child out of school for abuse?

Question Details:

I took my child out of his preschool because of abuse. Another mom also witnesses abuse with her child and decided to have the school investigated. I will join her and maybe 2 other moms also. Does she have the right to demand a months tuition because I didn't give her 30 days notice? Yes, I signed a contract. This is a nonprofit organization run by a veterans memorial center with a board of directors. We pay a normal preschool tuition ($550/mo part time). I want to demand all my money back. This is my worse nightmare come true!

You have stated that your child has been the victim of abuse at the pre-school, and that he may not be the only victim.  What kind of abuse are you referring to?  Physical abuse, emotional abuse, a combination thereof, etc.?  In any event, if you can document that your child (and others) was the victim of abuse, you should consult with an attorney to evaluate all of your options.  Not only should an attorney be able to get the preschool to back down from enforcing the contract, but the preschool may also be exposed to civil liability (whereby it has to pay YOU money) and criminal liability, depending on the nature of the abuse.  I suggest that you consult with a local attorney to discuss this matter in greater detail.  Good luck.
