Regardless of whether the defendant has complied or not, you should still answer your discovery as required. If/when you have to file a motion to compel the defendant to file an answer, you will want to be able to go to that hearing with "clean hands," instead of facing a counter motion to compel. You will get much farther in your request for relief if you have been compliant yourself.
