Wrongful Death - Accidental Death Law Answers

No. Insurance companies are only ever responsible up to the policy limit. That does not mean that the victim or his/her family (in a wrongful death case) can't sue the drunk driver for more than the policy limit, and if they win, they can look to collect the amount over the policy from the driver; however, the insurance company is only responsible up to the amount of the policy.
