Question: Divorce, Marriage, Alimony - New York

Asked on 11/8/2009

Can I keep married name if I divorce?

If my husband and I are divorcing and I want to keep my married name is that possible? My soon to be ex-husband is in agreement with this. Should I indicate this information in the divorce?

Incident to the divorce, the wife has the option of returning to the use of her maiden name. The decision to return to a maiden name is highly personal.  There is no need to indicate this in your divorce papers unless you want to change back to your maiden name.

You have the right to keep your married name or resume use of your maiden name.  I am a New York matrimonial attorney.  You can request that the judgment of divorce state that you have the right to resume use of your maiden name but are not required to do so.   Give me a call if you would like to discuss the situation.  It would be my pleasure to speak with you about the case.  Darren M.
